I am sending along a transcript of a deposition of him that i took just this past Monday. I am under major assault by the GMAC lawyers here in Portland. They are accusing me of bad faith in the taking of this deposition saying that I was taking it for the express purpose of use in cases other than the one that I deposed him in. Because they are looking for ways to nail me, I have not wanted to put the transcript into wide circulation until I put it into the public court record. That will happen toward the middle or end of this coming week. At that point I will post notice of it on the NACA listserv. In the meantime would both of you please keep this under wraps for just a few more days. I am gearing up to depose Stephan again in about a month in a case where he indorsed a note for GMAC Bank, also as a "limited signing officer". I think that I have the documents that he relies upon for authority to attempt to do this, and I am fairly sure that he has no power to indorse. These are exciting times here in Maine. In addition to the excitement last week with Stephan, I have an argument in the Maine Supreme Court on Tuesday where we have a very good shot at getting ruling that MERS does not have standing to sue in Maine. I have two more foreclosure appeals to the Maine Supreme Court coming within a few more months raising other foreclosure defense issues. And, we are just beginning to work on a case where we hope to take on MERS head on and ague that its "corporate signing officer" system is a sham and that their mortgage assignments are meaningless.
